Privacy Policy

This policy explains what personal data Fix My Debt collects, why we collect it, who we share it with, how long we keep it and the choices you have. It applies to this website (fixmydebt.in) and to our conversations with you on WhatsApp, email and phone. We handle personal data in line with Indian law, including the Information Technology Act, 2000 and its rules, and the Digital Personal Data Protection Act, 2023 and the DPDP Rules, 2025 as their provisions come into force.
1. Who we are
Fix My Debt is a private debt-resolution service based in Kolkata, West Bengal, India. We help adults in India understand and work through unsecured personal debt, such as credit card dues and unsecured loans. For the personal data described here, Fix My Debt decides why and how it is used (under the DPDP Act, we are the "Data Fiduciary"). You can reach us at ceo@fixmydebt.in or on WhatsApp.
2. What we collect
- Contact details: your name, phone or WhatsApp number and, if you give it, your email address.
- Your enquiry: the type of debt you select and what you write in the message box on our website form, and your consent choice.
- Information about your debts and finances that you choose to share during the assessment or later, such as lenders and card issuers, amounts owed, payment history, income and expenses, statements, notices, and credit reports.
- Records of our communication with you on WhatsApp, email and phone, and any written authorisation you give us to act for you.
- Fee records: which fees you paid, when and how much. We do not collect or store card numbers, card PINs, OTPs or banking passwords, and we will never ask for them.
- Basic technical data that our website host records automatically when you visit, such as IP address, browser type and pages requested, for security and to keep the site running.
This website does not use advertising or analytics cookies, and it does not track you across other websites.
3. Why we use it
- To reply to your enquiry and contact you about it.
- To carry out the initial guidance and debt assessment, and to explain your options and any further fees.
- If you choose to go ahead, to provide the agreed support, including communicating with your creditors or their representatives when you authorise us to.
- To keep records of fees and of our work, as tax, accounting and other laws require.
- To protect our website and services against misuse, spam and fraud.
We use your personal data only for these purposes. We do not sell it, and we do not use it to market other companies' products to you.
4. Your consent
We process your personal data on the basis of your consent, which you give when you tick the consent box on our form or when you share your details with us to take up our services. We may also process data where the law allows it without consent, for example to meet a legal obligation. You can withdraw your consent at any time by writing to ceo@fixmydebt.in. Withdrawing is as easy as giving consent. It does not affect processing we carried out before you withdrew. If you withdraw, we may no longer be able to continue helping you with your debts.
5. Who we share it with
- Your creditors, their recovery agents or lawyers: only the information needed, and only when you authorise us to act for you.
- Service providers who help us operate: Netlify (hosts this website and receives and stores messages sent through our form), Google Workspace (our email) and WhatsApp (operated by Meta) for messages you send us there. They process data on our behalf under their own security and confidentiality terms.
- Professional advisers such as lawyers or accountants, where needed for your case or for our own legal and accounting obligations, under a duty of confidentiality.
- Authorities: courts, regulators, law enforcement or other government bodies when the law requires it.
6. Where your data is stored
Some of our service providers, including Netlify, Google and Meta, may store or process data on servers outside India. Where data is transferred outside India, we do so as permitted by Indian law and rely on the providers' security safeguards.
7. How long we keep it
- Enquiries that don't lead to an engagement: we delete them once they are no longer needed to respond to you, subject to any minimum period the law requires.
- Client records: we keep them for as long as we are helping you, and afterwards for as long as tax, accounting or other laws require.
- Logs: where the law requires us to keep personal data and processing logs for a minimum period (for example, one year under the DPDP Rules), we keep them for that period.
After that, we delete the data or make it anonymous.
8. How we protect it
We use reasonable security safeguards to protect your data, including encrypted connections (HTTPS) on this website, access controls on our accounts, and limiting access to people who need it for your case. No method of storage or transmission is completely secure. If a personal data breach affects you, we will tell you without delay: what happened, the likely impact, what we are doing about it and what you can do. We will also report it to the Data Protection Board of India where the law requires.
9. Your rights
Under Indian law, you can:
- ask for a summary of the personal data we hold about you and how we use it, and who we have shared it with;
- ask us to correct, complete or update your personal data;
- ask us to erase your personal data, unless we need to keep it for the purpose you gave it for or to meet a legal requirement;
- withdraw your consent at any time;
- nominate another person to exercise your rights if you die or become unable to act;
- raise a grievance with us and, if you are not satisfied with our response, complain to the Data Protection Board of India.
To use any of these rights, email ceo@fixmydebt.in with the subject "Privacy request". We may need to confirm your identity before acting. We will respond as soon as we can, and within 90 days at the latest.
10. Grievances
If you have a concern about how we handle your personal data, contact our Grievance Officer at ceo@fixmydebt.in (subject: "Privacy grievance"). We will acknowledge your grievance and aim to resolve it within 30 days, and in any case within the time the law allows. You must first raise your grievance with us before approaching the Data Protection Board of India.
11. Children
Our services are only for adults aged 18 and over. We do not knowingly collect personal data from children. If you believe a child has sent us their details, please contact us and we will delete them.
12. Changes to this policy
We may update this policy from time to time. The current version, with its effective date, will always be on this page. If we make significant changes, we will tell clients we are working with.
